Welcome to the TLx online store. This store is operated by Tobias Beharrell under the Tobias Lab Canada and Tobias Lab Clinical Intelligence identities. In these Terms and Conditions, “TLx,” “Tobias Lab,” “we,” “us,” and “our” refer to Tobias Beharrell and the Tobias Lab Canada storefront.

These Terms and Conditions govern your access to this website and your purchase or use of any products, publications, services, or content offered through it. By accessing the website, placing an order, or purchasing a product, you agree to these Terms and Conditions.

If you do not agree with these terms, please do not use the website or place an order.

1. About the Store

The TLx store offers branded apparel, accessories, books, publications, educational materials, and related products.

Certain products are manufactured, printed, fulfilled, shipped, or processed by third-party service providers, which may include Fourthwall and its manufacturing, payment, and fulfilment partners. Your purchase may therefore also be subject to any terms, policies, or conditions presented by the applicable provider during checkout.

2. Eligibility to Purchase

You must be legally capable of entering into a binding agreement in your jurisdiction to place an order. If you are under the applicable age of majority, you may use the store only with the involvement and permission of a parent or legal guardian.

You agree to provide current, complete, and accurate billing, shipping, and contact information when placing an order.

3. Products and Product Representation

We make reasonable efforts to present products, colours, dimensions, materials, and designs accurately. However, colours may appear differently depending on your screen, device settings, lighting, fabric, printing method, or embroidery thread.

Because many items are produced individually or on demand, minor differences in colour, positioning, stitching, print texture, scale, or finish may occur. These normal production variations do not necessarily constitute a product defect.

Product images may include digital mock-ups intended to show the general appearance of an item. The finished product may differ slightly from the on-screen representation.

4. Availability and Order Acceptance

Products are subject to availability. We reserve the right to limit quantities, discontinue products, correct errors, or revise product descriptions and pricing at any time.

Submitting an order does not guarantee acceptance. An order may be declined or cancelled if:

• the product is unavailable;
• payment cannot be authorized;
• pricing or product information contains a material error;
• the order appears fraudulent or unauthorized;
• the shipping address cannot be serviced; or
• fulfilling the order would violate applicable law or provider requirements.

If payment has already been collected for an order that cannot be fulfilled, the applicable amount will be refunded through the original payment method.

5. Pricing, Currency and Taxes

Prices are displayed in the currency identified on the storefront or during checkout. Depending on your location and payment method, your financial institution may apply currency-conversion charges or other fees.

Applicable sales taxes, shipping charges, customs duties, import taxes, brokerage fees, and similar costs may be calculated during checkout or charged separately by the destination country or delivery provider.

Unless expressly stated otherwise, customers are responsible for customs duties, import charges, and other destination-specific costs.

6. Payment

Payments are processed through third-party payment providers. We do not directly control their authorization procedures, security checks, processing times, or payment restrictions.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your order.

7. Production and Shipping

Many TLx products are produced on demand. Production time is separate from shipping time.

Estimated production and delivery dates are provided as guidance only and are not guaranteed. Delivery may be affected by production volume, carrier delays, customs processing, weather, labour disruption, incorrect address information, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. We are not responsible for losses or additional costs caused by an incorrect, incomplete, or outdated address supplied by the customer.

Once a shipment has been transferred to the carrier, tracking and delivery are subject to the carrier’s systems and procedures.

8. Order Support, Cancellations, Returns and Refunds

Fourthwall provides customer service for orders placed through the TLx store, including questions or concerns relating to:

• order status and tracking;
• shipping or delivery;
• address changes;
• damaged, defective, or incorrectly produced items;
• missing or incorrect products;
• cancellations, where still possible;
• returns, replacements, and refunds; and
• payment or checkout issues.

Please include your order number, the email address used to place the order, a clear description of the issue, and photographs where the product is damaged, defective, or incorrectly produced.

For the fastest and most appropriate resolution, all order-related inquiries must be directed to Fourthwall rather than Tobias Lab. Tobias Lab does not directly administer Fourthwall’s payment, manufacturing, shipping, tracking, return, replacement, or refund systems.

Because many products are produced specifically after an order is placed, cancellation or modification may not be possible once production has begun. Return, replacement, and refund eligibility is governed by Fourthwall’s policies in effect at the time of purchase, together with any mandatory consumer rights that apply in the customer’s jurisdiction.

Nothing in these Terms limits any consumer right or remedy that cannot lawfully be excluded.

9. Books, Publications and Educational Content

Books, written materials, teaching lines, diagrams, and educational products offered through this store are provided for informational and educational purposes.

Nothing sold or displayed through the store constitutes medical diagnosis, individualized medical advice, treatment, prescribing, or a substitute for care from an appropriately qualified healthcare professional.

References to clinical intelligence, systems regulation, physiological observation, or related concepts describe the educational and professional context of Tobias Lab. They do not represent a promise or guarantee of any particular health outcome.

10. Intellectual Property

All content associated with the TLx store—including product designs, artwork, written content, teaching lines, photographs, graphics, layouts, publications, brand language, and visual materials—is owned by or used with permission by Tobias Beharrell and Tobias Lab Canada and is protected by applicable intellectual-property laws.

TLx™, Tobias Lab™, Tobias Lab Clinical Intelligence™, and their associated names, logos, symbols, designs, and visual identities are proprietary marks of Tobias Beharrell and Tobias Lab Canada.

Purchasing a product gives you ownership of that physical item for personal use. It does not transfer ownership of the design or grant a licence to reproduce, modify, manufacture, distribute, publish, sell, sublicense, or commercially exploit any logo, artwork, teaching line, written passage, or other protected material appearing on the product.

No TLx or Tobias Lab logo may be copied, redrawn, altered, recoloured, incorporated into another design, used to manufacture products, or presented in a way that suggests authorization, certification, affiliation, endorsement, or partnership without prior written permission.

The symbols ™ and ® must not be removed, changed, or used inaccurately. The ® symbol may only be used with a mark that has been formally registered in the relevant jurisdiction.

11. Professional and Certification References

Products referring to a practitioner, professional designation, course, program, or certification do not independently grant professional status, clinical authority, certification, or permission to represent oneself as affiliated with Tobias Lab.

Where a product is designated for certified practitioners, authorized participants, faculty, collaborators, or another defined group, purchase and use may be limited to individuals whose status has been verified or approved by Tobias Lab.

Unauthorized use of a TLx certification designation, practitioner title, credential, or affiliated mark is prohibited.

12. Acceptable Use of the Website

You may not use the website:

• for unlawful, fraudulent, deceptive, or abusive purposes;
• to interfere with the website’s operation or security;
• to obtain unauthorized access to accounts, systems, or customer information;
• to scrape, copy, reproduce, or commercially exploit website content;
• to impersonate Tobias Lab or misrepresent an affiliation with TLx;
• to upload malicious code or disruptive material; or
• to infringe the intellectual-property or privacy rights of another person.

We may restrict or terminate access to the website where misuse, fraud, infringement, or a material violation of these Terms is reasonably suspected.

Any warranties, conditions, or representations that cannot legally be excluded remain in effect.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Tobias Beharrell and Tobias Lab Canada will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from the use of the website, a delayed shipment, a third-party service, or the purchase or use of a product.

Where liability cannot lawfully be excluded, our aggregate liability relating to a particular order will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

17. Events Outside Our Control

We are not responsible for delay or failure caused by circumstances reasonably outside our control, including natural disasters, severe weather, fire, flood, epidemic, war, civil disruption, labour interruption, transportation failure, customs delay, carrier disruption, supply shortage, power failure, internet interruption, or failure of a third-party manufacturing or fulfilment service.

18. Changes to These Terms

We may update these Terms and Conditions to reflect changes in the store, available products, service providers, business practices, or applicable requirements.

The current version will be posted on this page with its effective or last-updated date. Changes apply from the date they are posted and do not ordinarily alter rights that already arose from a completed purchase.

Any dispute will be addressed in the courts of Manitoba unless applicable law requires another forum.
